Acceptance, Eligibility & Authority

These Terms of Use (“Terms”) govern your access to and use of pixelrainst.com and the website content made available by Pixel Rain Studios (“Pixel Rain,” “we,” “us,” or “our”). By using the website, you agree to these Terms to the extent permitted by law.

If you submit a business inquiry or act on behalf of a company, organization, or other person, you represent that you are legally permitted to provide the information you submit and, where applicable, are authorized to act on that party’s behalf.

If you do not agree to these Terms, do not use the website for submissions or other interactive features.

Website Purpose

This website provides information about Pixel Rain Studios, our creative services, portfolio, packages, starting prices, promotional rates, and ways to contact us. Website content is provided for general informational and marketing purposes.

Browsing the website, requesting information, or submitting an inquiry does not by itself create a client relationship, agency relationship, partnership, fiduciary relationship, service agreement, guarantee, or binding quote.

Services & Separate Project Agreements

Pixel Rain Studios may provide photography, videography, design, brand identity, web design, content creation, brand management, social media support, 3D visualization, creative direction, and related creative services.

Specific services are governed by the applicable written proposal, estimate, invoice, contract, statement of work, licensing terms, or other project agreement accepted by Pixel Rain Studios and the client.

Pricing, Quotes & Availability

Prices displayed on the website are starting points, examples, promotional rates, or general package information unless expressly stated otherwise. Final pricing may vary based on scope, complexity, production requirements, locations, travel, talent, licensing, equipment, revisions, deliverables, deadlines, usage rights, and other project-specific factors.

Nothing on the website is a binding quote or promise of availability. A project is not confirmed until the applicable scope and terms are accepted and any required deposit, retainer, or payment specified in the project agreement has been received.

Website pricing and availability may change for future inquiries without notice. Changes do not retroactively alter pricing already fixed in an accepted written agreement.

New Client Intro Rate & Promotions

Where displayed, the Pixel Rain Studios New Client Intro Rate is a promotional rate intended for eligible new clients on qualifying monthly plans.

• The current introductory offer is 10% savings during months 1–3 on eligible monthly retainers displayed on the website.
• The monthly plans have a 3-month minimum commitment unless a written project agreement states otherwise.
• If the client continues after the initial 3-month term, the standard monthly rate begins in month 4 unless a written agreement states otherwise.
• Promotional rates have no cash value and may not be combined with other promotions unless Pixel Rain Studios agrees in writing.
• Eligibility, availability, deliverables, start date, and final terms remain subject to an accepted written project agreement.

Pixel Rain Studios may modify or withdraw promotional offers for future clients, but an accepted written agreement controls any promotional pricing already committed to a client.

Payment, Deposits, Cancellations & Revisions

The website does not establish universal payment, deposit, refund, cancellation, rescheduling, revision, licensing, or delivery rules for every project. Those terms vary by service and will be stated in the applicable proposal, invoice, statement of work, or client agreement.

Do not rely on a general website description as a substitute for the payment or cancellation terms in your project agreement.

Portfolio, Creative Work & Intellectual Property

The website may display photography, video, branding, logos, menus, websites, design presentations, renders, graphics, client work, and other creative materials for portfolio, identification, or demonstration purposes.

Except where rights belong to a client, collaborator, platform, licensor, or other third party, the Pixel Rain Studios name, website design, graphics, copy, layouts, visual systems, code, photographs, videos, and original creative materials are owned by or licensed to Pixel Rain Studios and are protected by applicable intellectual-property laws.

Client names, logos, trademarks, and other third-party materials remain the property of their respective owners. Their appearance in the portfolio does not imply that Pixel Rain Studios owns those third-party rights.

No website content grants you a license to copy, reproduce, modify, distribute, sell, sublicense, scrape, republish, commercially exploit, reverse engineer, create derivative works from, or use the material to train or develop an artificial-intelligence or machine-learning model without permission from the applicable rights holder.

Information & Materials You Submit

When you submit information, files, links, logos, photographs, video, copy, brand materials, or other content to Pixel Rain Studios, you represent that you have the right to provide that material and that our receipt and reasonable use of it for the requested inquiry or project will not violate another person’s rights.

You grant Pixel Rain Studios a limited, non-exclusive right to receive, review, reproduce, transmit, and use submitted materials only as reasonably necessary to evaluate your inquiry, communicate with you, prepare a proposal, or perform services under an applicable project agreement.

A general inquiry form is not a secure data room and does not create a nondisclosure agreement. Do not submit trade secrets, passwords, payment-card data, government identification numbers, or other highly sensitive or confidential information unless we have agreed on an appropriate method and, where needed, a separate confidentiality agreement.

Testimonials, Endorsements & Client Statements

Testimonials and client statements on the website are intended to reflect the individual client’s genuine experience with Pixel Rain Studios. A testimonial may be edited for grammar, length, formatting, or clarity only if the substance of the client’s opinion or experience is not materially changed.

Pixel Rain Studios does not knowingly publish fabricated or false testimonials. If a material connection exists beyond the ordinary client relationship and applicable law requires disclosure, Pixel Rain Studios will make an appropriate disclosure.

Testimonials describe individual experiences and do not guarantee that another client will obtain the same creative, marketing, audience, revenue, or business results.

Pixel Rain Studios Branding

The Pixel Rain Studios name, logos, marks, distinctive visual identity, and related branding may not be used in a manner that suggests sponsorship, partnership, affiliation, endorsement, certification, or authorization without prior written permission.

Website Designs, Renders & Examples

Website screenshots, layouts, interface concepts, renderings, design presentations, prototypes, or examples displayed in our portfolio demonstrate creative capabilities and prior work. They do not guarantee that every style, feature, platform, integration, technology, or implementation is available for every project.

Acceptable Use & Site Security

You may not use the website to:

• Attempt to gain unauthorized access to the website, hosting environment, accounts, forms, databases, or systems.
• Introduce malware, malicious code, automated attacks, abusive traffic, scraping tools, credential attacks, or other harmful technology.
• Interfere with website operation, security, availability, or another person’s use of the site.
• Scrape, harvest, copy, reproduce, or exploit substantial portions of the website or portfolio without authorization.

We may block, restrict, or investigate access that appears abusive, malicious, automated, or unlawful.

The website may contain links, embeds, maps, videos, social posts, booking tools, or other content provided by third parties such as Instagram or other platforms. Pixel Rain Studios does not control and is not responsible for the availability, accuracy, security, privacy practices, policies, content, or actions of third-party services.

Your use of third-party services is governed by the third party’s own terms and policies.

Electronic Communications

If you contact Pixel Rain Studios and provide an email address or phone number, you consent to receive communications reasonably related to your inquiry, consultation, quote, scheduling, or project through the contact methods you provide.

Submitting an inquiry does not by itself constitute consent to unrelated automated marketing messages. Where separate consent is legally required for marketing communications, Pixel Rain Studios will obtain that consent separately.

No Guarantee of Business or Marketing Results

Creative services can support branding, marketing, communication, audience growth, advertising, and business development, but results depend on factors outside Pixel Rain Studios’ control.

Website Accuracy & Availability

We try to keep website information accurate and current, but content may occasionally be incomplete, outdated, unavailable, contain typographical errors, or differ from a later written proposal. We may modify, suspend, remove, or update website content, packages, promotional rates, features, or availability at any time for future visitors.

We do not guarantee uninterrupted or error-free access to the website.

Website Disclaimer

To the maximum extent permitted by applicable law, the website and website content are provided on an “as is” and “as available” basis without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

This website disclaimer applies to use of the website itself. Any warranties or commitments expressly stated in an accepted client agreement are governed by that agreement.

Limitation of Liability

To the maximum extent permitted by applicable law, Pixel Rain Studios will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising solely from your access to, use of, inability to use, or reliance on this website or third-party content linked or embedded through it.

To the maximum extent permitted by applicable law, Pixel Rain Studios’ aggregate liability arising solely from use of this website, excluding liability governed by a separate client agreement, will not exceed the greater of one hundred U.S. dollars (US $100) or the amount, if any, you paid specifically for access to this website during the twelve months preceding the event giving rise to the claim.

Nothing in these Terms excludes or limits liability that cannot legally be excluded or limited.

Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless Pixel Rain Studios from third-party claims, liabilities, damages, losses, and reasonable costs arising from your unlawful misuse of the website, your violation of these Terms, or materials you submit that infringe or violate another person’s rights.

This website indemnification provision does not replace any project-specific indemnification provision contained in a separate client agreement.

Intellectual-Property Complaints

If you believe content displayed on the website infringes your copyright, trademark, privacy, publicity, or other intellectual-property right, contact Pixel Rain Studios with enough information to identify the right claimed, the material at issue, its location on the website, your contact information, and the basis for your request.

Pixel Rain Studios may remove, restrict, or investigate disputed material when reasonably appropriate. This section does not designate a statutory DMCA agent or waive any rights or defenses available under law.

Service Area, U.S. Travel & International Remote Services

Pixel Rain Studios is based in the Dallas–Fort Worth area of Texas. In-person photography, videography, production, event coverage, meetings, installations, and other physically delivered services are offered within the United States only, on a project-by-project basis and subject to availability.

At a client’s request, Pixel Rain Studios may travel within the United States for an accepted project. Projects outside the Dallas–Fort Worth area may include additional charges for mileage, airfare, lodging, ground transportation, parking, tolls, baggage, equipment transport, location fees, permits, venue requirements, per diem, additional crew, extended travel time, or other reasonable travel and production expenses.

Material travel costs will be disclosed or approved through the applicable estimate, proposal, or project agreement before they are incurred whenever reasonably practicable.

Unless otherwise agreed in writing, the client is responsible for providing accurate location information and for obtaining any property permissions, venue approvals, access authorizations, releases, or site-specific permissions that are the client’s responsibility and are necessary for the requested production.

Pixel Rain Studios may work with clients located outside the United States only for services that can be performed and delivered remotely or virtually, such as web design, graphic design, brand identity, creative direction, consulting, editing, digital deliverables, and similar remote services. Physical production or travel outside the United States is not offered through this website.

Out-of-state or international remote projects may be subject to additional project-specific terms, payment methods, tax requirements, platform limitations, or mandatory laws that cannot legally be waived. The applicable written project agreement controls those project-specific details.

Governing Law & Disputes

These Terms and disputes arising solely from use of this website are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where applicable law requires otherwise. This provision does not waive mandatory rights or obligations that cannot lawfully be waived under the law of a U.S. state where in-person services are performed or, for remote international projects, under any mandatory law that validly applies to that project.

To the extent permitted by law, you consent to the personal jurisdiction and venue of state or federal courts in Texas having jurisdiction over the location of Pixel Rain Studios’ principal place of business at the time the dispute arises.

Nothing in this section prevents either party from seeking appropriate injunctive or equitable relief for misuse of intellectual property, security threats, or other circumstances where such relief is legally available.

Severability, Waiver & Assignment

If any provision of these Terms is held unlawful, void, or unenforceable, that provision will be enforced to the maximum extent permitted and the remaining provisions will remain in effect.

A failure by Pixel Rain Studios to enforce a provision is not a waiver of that provision or any other right. You may not assign your rights or obligations under these website Terms without our written consent where consent is legally required; Pixel Rain Studios may assign these Terms in connection with a reorganization, merger, sale of assets, or similar business transaction.

Entire Website Terms

These Terms, together with the Privacy Policy and any notices expressly incorporated into them, constitute the agreement governing use of this website. They do not replace a separate client agreement governing paid creative services.

Changes to These Terms

We may update these Terms from time to time. Revised Terms will be posted on this page with an updated revision date. Changes apply prospectively to website use after they are posted, to the extent permitted by law.

Changes to these website Terms do not retroactively rewrite a separate signed or accepted client agreement.
